After years of legal turmoil and XRP price suppression, the court ruled in July 2023 that XRP is not a security and non-institutional XRP sales don’t count as securities offerings. The community celebrated the anniversary of this pivotal ruling in 2024, and will very likely continue this tradition as this ruling cemented XRP’s regulatory clarity, and began a stream of victories for Ripple over the SEC. Despite numerous losses, former SEC Chair Gary Gensler refused to back down in his war on crypto, appealing the ruling after the judge handed down a final decision in August. Current Status of the Lawsuit The SEC filed its opening brief on January 15, 2025, and Ripple has committed to filing its cross-appeal brief by April 16. While this procedural move by Ripple aligns with legal norms, the appeal’s outcome remains uncertain. Observers closely watch the agency’s actions, especially as Donald Trump is president and a pro-crypto chair now leads the SEC. Jeremy Hogan, a well-respected attorney, recently speculated on a potential timeline for the new administration to dismiss the lawsuit because of its pro-crypto stance.
